On February 24, 2023 the DEA released Proposed Rules for Permanent Telemedicine Flexibilities following the scheduled end of the federal COVID Public Health Emergency (PHE) on 5/11/23.
The proposed rules have significant implications for telehealth providers who prescribe schedule II-V controlled substances including requirements related to in-person medical evaluations, pharmacy notification for prescriptions issued via telehealth, recordkeeping obligations and required registration(s) for interstate prescribing.
While the proposed rules are intended to provide safeguards for certain telemedicine consultations, some have the potential to negatively impact patients who have benefited from increased access to behavioral health services under the current expanded PHE telehealth flexibilities.
The Massachusetts Coalition of Nurse Practitioners (MCNP) is holding a Joint Virtual Town Hall Meeting with the Massachusetts Association of Advanced Practice Psychiatric Nurses (MAAPPN) on Thursday, March 9th at 7:00 PM to answer questions about the proposed rules and plans to submit comments to the DEA.
